This includes cutting floor bolts flush, securing any resulting hazards, disconnecting utilities safely, removing debris, cleaning spills, and leaving the area broom clean. Buyers and their contractors must follow all applicable safety and environmental laws and are responsible for any damage, injury, spills, hazardous materials, or property damage caused during removal. Vehicles may not idle inside enclosed buildings.AssetBuilt may inspect vehicles, toolboxes, and removal equipment. Theft or suspected theft may result in immediate loss of removal privileges and referral to law enforcement. TITLE, RISK OF LOSS & LIABILITY Once a Lot is declared sold, the Buyer assumes all risk of loss, theft, damage, or destruction.Title and possession remain with AssetBuilt until the Buyer’s invoice is paid in full. No items will be released before full payment.If an item cannot be delivered, the Buyer’s sole remedy is limited to a refund of amounts paid for that item. AssetBuilt will not be liable for incidental, consequential, or special damages. DEFAULT — FAILURE TO PAY OR REMOVE Failure to pay in full, remove purchases by the stated deadline, or comply with these Terms constitutes default. In the event of default, AssetBuilt may retain deposits, resell, scrap, remove, store, or otherwise dispose of the items without further notice. The Buyer remains responsible for any deficiency, storage, removal, administrative, collection, legal, and related costs.Time is of the essence for both payment and removal. AUCTIONEER’S RIGHTS AssetBuilt has sole authority over the conduct of the auction, and its decisions are final.The Auctioneer may add, remove, combine, divide, regroup, reorder, or withdraw Lots; reject bids; establish bidding increments; offer items in bulk; and otherwise modify the sale as necessary.Auction dates, Lots, and scheduled sales may be changed or cancelled without advance notice. BIDDER DISPUTES If a dispute arises between bidders, the Auctioneer may determine the successful bidder, reopen bidding, or resell the Lot. The Auctioneer’s decision will be final. ESTIMATED WEIGHT, COUNT OR MEASURE Items sold by estimated weight, quantity, or measure will be invoiced based on the estimate. Any verified shortage or excess may be adjusted at the applicable bid rate. ONLINE & WEBCAST BIDDING AssetBuilt does not guarantee uninterrupted or error-free operation of any online or webcast bidding platform.Electronic bids are binding once submitted. AssetBuilt may accept, reject, or remove electronic bids at its discretion. RISK TO PERSON & PROPERTY Anyone entering the auction or removal site assumes the risks associated with being on the premises.Buyers agree to release and indemnify AssetBuilt from claims arising from injury, property damage, site conditions, or removal activities caused by the Buyer or their representatives. BIDDER INFORMATION & MARKETING By registering, bidders authorize AssetBuilt to use their contact, bidding, and transaction information for auction administration, future auction notices, marketing, advertising, analytics, and other lawful business purposes.AssetBuilt will not sell personally identifiable information to unaffiliated third parties for independent marketing without consent. Bidders may opt out of non-transactional marketing communications. REVIEWS, PHOTOS & TESTIMONIALS Any review, testimonial, photo, video, or other content voluntarily submitted to or publicly shared with AssetBuilt may be used for marketing and promotional purposes.The Bidder represents that they have the right to provide such content and that it does not violate the rights of others. GOVERNING LAW These Terms are governed by the laws of the State of California. Any dispute will be handled in the agreed jurisdiction, and the prevailing party may recover reasonable legal fees and costs where permitted. FINANCIAL OBLIGATIONS The Buyer authorizes AssetBuilt to collect amounts properly due under the auction invoice and agrees to be responsible for applicable collection costs, legal fees, and lawful interest on unpaid obligations.ENTIRE AGREEMENTThese Terms, together with any auction-specific amendments or announcements, constitute the complete agreement between AssetBuilt and the Bidder. ACCEPTANCE OF TERMS By registering, bidding, or participating in an AssetBuilt auction in any manner, the Bidder agrees to be bound by the official Terms and Conditions. A physical signature is not required for acceptance. Participation or submission of a bid constitutes acknowledgment and acceptance of the applicable auction terms.
